Simple party wall agreement and schedule of condition with photographs where an adjoining owner wished to reconstruct her conservatoy immediately adjacent to the boudnary and within 3.0m of the adjoining owners house.

I have been appointed to act by Mr and Mrs to prepare a report in respect of Party Wall Act works at 150 Road following the party wall notice of 31st December 2018.
Description
The properties are typical Edwardian terrace houses with rear projections accommodating a kitchen and room above. The rear projections of the properties are not attached. A conservatory has been constructed between the rear projection of 150 and boundary. There is a path between the boundary and projection of 148.
The owner of Number 150 proposed to demolish the existing conservatory and construct a kitchen extension Architects have drawn up plans PL 149 – 02 and PL 149 – 03 detailing the foundation of the property.
It is proposed to excavate an approximately 1.0m depth trench immediately adjacent to the boundary to accommodate the foundation of the conservatory.
The works are considered to be of a routine nature and should not pose a particular threat to either property unless large quantities of unstable filled material is encountered which is considered to be unlikely given the history of the site.

Steven Butler Limited takes no responsibility for approving the plans of the proposed works, methodology for implementing them, or health and safety responsibilities.
Precautions:
The owner of 150 or their contractors must hold insurance against damage to 148 or injury to occupiers from the works.
The works must comply with local authority and other legislative requirements.
The works must not interfere with 148’s Right to Light.
The excavation must have barriers to prevent occupiers of 148 falling into it.
The side of the excavation must be properly supported if left unattended. Ideally the excavation should be undertaken as soon before the pouring of the concrete as possible.
Any ground within 1.0m to the rear wall of the main part of the properties and below a line projecting downwards by forty five depress from foundation level must only be excavated immediately before the concrete is poured.
Should any soil collapse from under the existing foundations of the houses the void must be filled with properly compacted concrete.
The side path at Number 148 should continue to be supported if left unattended until brickwork reaches that level.
The path of 148 should be protected against spillage of mortar etc. during construction of the flank wall of the new conservatory.
Any damage caused to services serving 148 should be rectified immediately and they should then be properly tested. Other damage to be rectified within seven days.
Current Condition
A schedule of existing damage to 148 follows as an Appendix
There was no other evidence of fracturing at the property or deflection of the brickwork or floors due to foundation movement.
Fees
The Act makes the owner of the building to which Party Wall Act works are being undertaken responsible for my fees. These are £350.00 plus VAT
This award under the Party Wall Act 1996 which shall be valid for six months is agreed
